Will they be able to get them for price gouging, unlikely. Unless Korean law is completely different (and it might well be), its really hard to get price gouging to stick on what is basicly a optional service (unlike say food or gas).
Also, I believe that the boiler plate for all of NCSoft's game make for cash trading against the CSA. Now if this were one of the MMORPGs that have embraced buying/selling, it be a different story, but its not.
Personally, I think its someones lawyer taking them for a ride.
Korean Players to Sue NCSoft?
It seems in Korea, online gamers are making good on that eternal disgruntled player threat. They are giving NCSoft notice that they are suing claiming price gouging and lack of enforcement of online for-cash sales of in-game items.
