No. A ban would be the Court ruling that no state could expand their marriage status to include same *** couples. You know, "banning" SSM. What's being asked here, isn't if a state *may* expand their marriage status in this way, but if every single state *must* do so. That's an entirely different question.

Nope. Barring being an actual recipient of a frontal lobotomy, it's difficult to see how one creates the argument 'allowing a state to ban a state law isn't a ban"

That... doesn't make a lick of sense.

Holding: Fourteenth Amendment requires a state to license a marriage between two people of the same sex. And to recognize a marriage between two people of the same sex when a marriage was lawfully licensed and performed out of state.

5-4, Kennedy with the liberal bloc.

From SCOTUSBlog:
Quote:
The opinion seems to go out of its way not to state a standard of scrutiny. Instead, it says, "It is now clear that the challenged laws burden the liberty of same-sex couples, and it must be further acknowledged that they abridge central precepts of equality . . . Especially against a long history of disapproval of their relationships, this denial to same-sex couples of the right to marry works a grave and continuing harm. The imposition of this disability on gays and lesbians serves to disrespect and subordinate them. And the Equal Protection Clause, like the Due Process Clause, prohibits this unjustified infringement of the fundamental right to marry."
[...]
The opinion appears to echo Windsor in its dual rationales: Marriage is a fundamental right in which homosexual couples must share, and it would also be a violation of equal protection to extend that right only to heterosexual couples.
[...]
From the concluding paragraph of the majority opinion: "No union is more profound than marriage, for it embodies the highest ideals of love, fidelity, devotion, sacrifice, and family. ... [The challengers] ask for equal dignity in the eyes of the law. The Constitution grants them that right."
[...]
From the majority opinion, addressing the role of history in the constitutional analysis: "The nature of injustice is that we may not always see it in our own times. The generations that wrote and ratified the Bill of Rights and the Fourteenth Amendment did not presume to know the extent of freedom in all of its dimensions, and so they entrusted to future generations a character protecting the right of all persons to enjoy liberty as we learn its meaning."

It's both amusing and disappointing just how much money is being used to argue what "equal" means. Oh well, I'm honestly more excited for the reaction after "war on religion" doesn't work.

Speaking of, the opinion states that religious institutions are still free to argue against SSM based on the First Amendment.

I switched to Fox News, because that's where you go to rational discussion of current topics, and the generic blond was commenting about polygamy.

Not Free Republic?

Come on. I've learned that Western civilization is now doomed, the nation is over, Christians need to move out of America because it's hostile and they're next, you should stick it to the state by not getting married any more and just making legal contracts (oh, the irony), polygamy polygamy polygamy, Reagan's legacy is now that he ruined America by nominating Kennedy to the Supreme Court, polygamy incest polygamy incest polygamy, life-time appointments to the SCotUS need to end, in ten years "Child Marriage" will be legal, and that the end times are upon us.

I have to say that I really enjoy the cognitive dissonance generated when Make Believe Super Regan clashes with Actual Regan.

I like the amount of hubris in thinking that NOW the end times are upon us. God wasn't thrilled with gay marriage in Spain or Canada or Iceland but once it happens in the SUPREME HOLY AND ANOINTED UNITED STATES, it's time to unleash the seven headed dragon to sweep a third of the stars out of the sky.

This is an honest question that will probably seem like I'm baiting you, but how do you personally reconcile all of the crazy **** in Revelations? Metaphor?

Metaphor. Revelation was almost certainly written as a coded message of hope to Jewish-Christians following the fall of Jerusalem and about the desired fall of the Roman Empire. It's written in symbolism that mean something if you grew up studying Judaism and sounds like freaky fantasy if you just take it literally. This doesn't mean that it wasn't inspired or that it can't hold spiritual relevance to today's readers but the notion that it's a playbook for the end of the world goes against Jesus' warning that his return will be sudden and unexpected. Playing the "So now we know that ISIS is the Horseman of War and AIDS is Pestilence and Social Security numbers are the Mark of the Beast..." game is essentially saying that you're smarter than Jesus.
